Federal Court Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer human smuggling charges, he was detained in immigration custody.

In her order, the court noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
